Marriage & Divorce

Marriage law refers to the legal requirements that determine the validity of a marriage, and which vary considerably among countries. Marriage is an institution that is historically filled with restrictions. From age, to gender, to social status, various restrictions are placed on marriage by communities, religious institutions, legal traditions and states. A marriage can end when one partner dies, by divorce or by annulment. Divorce laws vary significantly by country. 

 

Divorce disputes are one of the most common civil cases. A variety of reasons such as incompatible personalities between husband and wife, conflicts between family members, and family economic disputes may make it difficult to maintain a marriage relationship. At present, there are two ways to dissolve a marriage in China, one is divorce by agreement and the other is divorce by lawsuit. Divorce by agreement mainly involves the issue of the cooling-off period of divorce, while divorce by litigation involves many issues, mainly in three aspects:

  • dissolution of the marriage relationship

  • the issue of child custody

  • the division of marital property
